Illegal Immigrants asre coming in to the USA and giving birth to childern to become citizens. In my ROTC class we've been discusing Guest Worker Program and ect. and it lead to Anchor Babies. Someone believes that the child that was born in the USA but parents are illegal immigrants, can be taken away. Is that true? Please have a source of somewhat.

No Anchor Babies and we will be working on kicking them out next!

We're just a piece of FREE meat to illegal aliens. Why should we feel sympathetic about an illegal alien with an anchor baby? If you break the law, you should be prepared to live with the consequences... The 14th Amendment was not a grant of citizenship! It did not confer citizenship! It merely defined citizenship and the manner by which it could be obtained.

The Constitution says that any, “Any child born to a ‘LEGAL’ immigrant shall be a naturalized citizen.”

Nowhere does it say ‘illegal’. Point blank!

No Amendments apply to illegal aliens. “Fraud destroys the validity of everything into which it enters” Nuud V. Burrows, 91 U.S. 426 This means no 14th Amendment Protections.



The Federation for American Immigration Reform says taxpayers spend $12 billion a year on primary and secondary school education for children here illegally. Another $17 billion for the American-born children of illegal aliens, known as anchor babies.

America values birth right citizenship to aliens that LEGALLY enter the United States. Americans do not want to support illegal immigrants sneaking across the boarders taking advantage of Americas public assistance, housing and education and medicare programs.

These illegal anchor babies are a burden to the American society. Taxpayers do not want to support them or their parents. These anchor babies should not be granted citizenship just because their parents broke federal laws getting here.

Under current law, a child born on U.S. soil, despite the legal status of his or her parents, is entitled to all benefits that U.S. citizenship entails, including federal welfare benefits and the right to vote. When that child turns 21, he or she is able to sponsor his or her entire family so they may have legal status in the United States.

Miller and his supporters hope to change this practice.



“More than 120 nations, including Germany, Japan and Italy, do not grant automatic citizenship to children born to illegal immigrants,” said Miller. “The United States must wise up and join the rest of the industrialized world in acknowledging that caring for, educating and integrating unregulated waves of immigrants is not sustainable.”

At the present time, to my knowledge, a child born on US soil or airspace is considered and American citizen by birth.
The legal or illegal status of the parents have no bearing on the child except to the degree that the child has citizen protection rights that are that for any or all other Americans.
The parents do not get American citizenship by a birth here on American turf. The parents are still deportable if caught and it is up to them if the wish to take the child with them when deported. The child can not or will not be taken from the parents, even if they are here illegally. I suspect that if the parents were charged with reckless endangerment or child abuse, the child could be taken from them in that scenario.
I personally am hoping our leaders will do away with the anchor baby situation and make it mandatory that all immigrants go through naturalization process LEGALLY to gain citizenship.
All other first world countries in the world do not allow automatic, anchor baby citizenship. The USA is the last and only one. Scuttlebutt says that the anchor baby thing is under review currently and may be discontinued.

Parents are illegal immigrants because their status doesn't change. The common interpretation of the 14th Amendment to the Constitution is that a child born here is a citizen regardless of legality of the parents, however, the Supreme Court in holding that way for a child where the parents were legally here specifically reserved the question of whether it would be the same for a child of illegal immigrants. Nothing changes for the parents, however, they are either legal or illegal depending on their personal status.

I don't know exactly what you want a source for, the deportation of parent issue? Obviously, they can take the child with them, no one is separating them. The thing is, since lower courts treat the child as a citizen, the child then would have the right to stay.

Elvira Arellano first lost an injunction against her deportation when she argued that as a parent of a citizen she had rights to stay, then 'her son' lost his suit for an injunction arguing that his rights as a citizen were violated if he was separated from his mother or forced to go with her. The court rejected both arguments. It is well settled law, and parents are deported all the time. There is a suit in Florida on behalf of children of illegals much as Elvira Arellano's son's suit was, but I expect it to fail as well.

Or is it the citizenship of the child issue you are looking into? Diplomats who have children here do not get citizenship of their children because the children are deemed not to be under the jurisdiction of the laws of the US. As I said, the Supreme Court withheld an opinion on whether children of illegals were citizens. However, lower courts and goverment agencies treat them as if they were citizens.

Under our constitution currently, anyone born withing the boundries of the US are US citizens. There is one exception to this and that is for Diplomats of foreign countries.

The only thing is that they HAVE to provide a birth certificate that the child was born within the country. Without that, they should not be classified as a US citizen.

I believe this "anchor baby" syndrome needs to be addressed and the citizenship should follow that of the parents if they are illegals. This would require a constitutional amendment, however.

It's the 14th amendment to the Constitution of the United States, and it's under dispute, because people are gaining entry to the United States by having a baby in the country, then the parents get a green card etc. Well, with something like 5,000 people a day(high estimate) trying to come to the US illegally, and hospitals in the United States closing down for lack of funds due in large part to no payment for services rendered to illegal aliens, including pregnancy care, the 'anchor baby' issue is being discussed in terms of amending or abolishing it, as the original 14th amendment was meant to address the needs of then-slaves and their descendants. But, now that we've got the 'anchor baby' fun,
the whole process has gone 'runaway'. Some people are in favor of letting 'anchor babies' go forward, others are against it, and instead favor deporting the entire family. It's a tough question, with humanitarian angles, but it's still not right for it to go on, in my view...Mexico needs to build hospitals to take care of their own people...

An anchor toddler will in basic terms help after it turns 21. At that factor it could petition the father to return to the U. S. as a eco-friendly card holder. with any luck "Suzanne" could have already gotten her husband a eco-friendly card long before then. Having a toddler won't help. it won't velocity issues up. it won't make it extra handy. it won't get him citizenship, a eco-friendly card, a visa or the rest. tell "Suzanne" to attend till they actually prefer a toddler to have one. it extremely is going to be extra effective that way! observe: It takes 5 years for a eco-friendly card under widely used circumstances.

It may seem harsh to deport anchor babies, but it needs to be done for consistency. When they grow up, they will likely have ties to their parents in Mexico and might try to help them back over. We need to deport all illegals, including their children (or just send Angelina Jolie to Mexico).

If your parents were illegal so are you, the amendment in the Constitution that states this needs to be repealed. it hurts this country and our founding fathers never wanted it that way

No they can't take the babies away from those parents. They still have parental rights. If parents are deported.....babies go with them. If one parent is illegal and the other is legal. Then usually that parent chooses either to leave with the illegal spouse and carry the children or stay here with the children and just live here in a 1 parent home. NOW what happens racist America when this child born here, CITIZEN comes back or remains here and remembers what you did to his parents and family. Either you sent this citizen (child) back into poverty or you forced him to live in a home with the absence of one of his parents.........
