First of all, this is a dead serious question. Please don't post a BS answer because this is serious.......1 month ago my uncle came to my house and punched me in the face ATLEAST 12 times as hard as he could. I am a 17 yr. old male but this man is 6'4 310 pounds. I will try not to go into alot of detail but it was not my fault for him getting mad and punching me (neighbor lied and told him i threatened to cut of someones head which is a straight up LIE)......i figured since i am legally a minor (17) that i could sue him or get my family to sue him or something......my face is just now starting to recover from the beating and he DID leave blood.......I am upset right now because the same day he hit me, i called the police and filed charges, and they said "well, we'll see what the DA (district attorney) SAYS about it"...It is way too much to type on here but i just need some advise on what to do because they have no contacted me yet and its been a little over a month...advise appreciate

markgetsetgo, yes, i had my father take photos of my face...delta, i'm telling the God's honest truth...i have no clue why they ignored it. I live with my grandparents and they witnessed this but didn't call the police immediately...God its a long story... but i called the police later that day, about 6 hours after it happened.

shaneh, my mother was there and she counted the number of times...she couldn't have helped in no way shape or form and there was no phone.........as for 6'4 310, he does NOT punch very hard, but enough that there were bruises all over my face, in particular, my mouth and he left blood. The fact is i didn't try to punch him back because i was in such a state of shock and i never thought he would punch me like that......i don't know much about the DA other than what the police briefly said........as you can see, i obviously don't know much about what to do about this.I am very depressed and stressed, have insomnia and everything else...my apologies if i cant explain right

TAKE YOUR PICTURES AND ANYBODY WHO WITNESSED IT TO YOUR COUNTY MAGISTRATE JUDGE AND SWEAR OUT A WARRANT FOR HIS ARREST FOR BATTERY . MOST PEOPLE DONT KNOW BUT YOU CAN SWEAR AN ARREST WARRANT ON YOUR OWN . TRUST ME THIS WILL GET THEIR ATTENTION.NOBODY HAS THE RIGHT TO PUT THEIR HANDS ON YOU UNLESS ITS SELF DEFENSE.

Here are the hard questions.
1.How do you know he "punched" you 12 times ?
2.This is assault on a minor by an adult,if the police failed to respond to your call for help,seek the advise of an attorney.
3.At 6'4'' and 310 pounds you should have no face left after 12 punches.How long were you hospitalized ?
4.What were the extent of your injuries ?
5.The "DA" is not the one who makes the decision as to whether an arrest is made at the time of the offense,the DA decides on what charges he will place and then get a warrant for an arrest if at a later date.
I don't doubt your story,but something is missing.There is to much "wrong" with your story.Get a good attorney and seek court action.

If this is happened the way you say, then he is atleast guilty of assault and battery. Depending on the damage, it may even be assualt and battery of a high and aggravated nature. I would first get a restraining order against him. If you have a police report and pictures of the injuries this will not be hard. As far as criminal charges go, in my state the victim is capable of pressing charges without a prosecutorial endorsement. All you have to do is go to a local magistrate and file for a warrant for his arrest. Be sure you have the evidence because in this scenario, you will be burdened with proving that you did not provoke his reaction.
As far as civil action, if you take him to court and have him convicted of criminal negligence, then civil action is pretty cut and dry after that. Again, in my state this can be done through a local magistrate for any damages of 5,000 dollars or less. If you cannot have him convicted criminally, then civil action is a little tougher.

If what You read is true then Yes, I believe the Mother should get the maximum charge that could be given to her. Leaving children at the age of 2,3,and 4 home alone for more than a few minutes anything could happen. That is pure neglect. I don't believe the laws are strict enough anywhere in the United States for this type of behavior. Where I live, a very small town, she would be strung up by the town marshal (yes, I said town marshal) we don't have a large police station or even a jail, the town is so small. Our town is from the old school so she would definitely be in big time trouble here. We don't have much crime in our little town (things like jay walking maybe). If anything bad happened they would be transferred to next big city which would be Ft Wayne, Indiana, I live in Churubusco, In. Women that can't take care of their children and be responsible shouldn't have them. There is absolutely no excuse for leaving them alone at that age for any length of time.

he should have been arrested for felonious assault if not invited to come inside the house,unlawfully entry burglary restrain you is kidnapping your age is not the issue here call the district attorney office or personally go see the magistrate office an you file a complaint with arrest warrant

You are still under the eye of child welfare. But even if you just call the cops, they should make the report.

File charges. Even when my 17 yr old son makes me feel like killing him, I still know better than attacking him like that. If your uncle was smarter, he'd call the cops on you instead of beating you, for whatever you did, and ended up as the good guy.

I am appalled that he was not arrested that day. Who in the hell took that police report and why did they not follow up on it/? For Gods sake what are law enforcement paid for if they are going to ignore a brutal beating like that? I don't care what you did ,I don't believe any adult had the right to punch you ever. Why haven't your parents followed up on this? Where the hell is the decency in this god forsaken country anymore? I am tired of people that should be in jail walking free and traffic citations are filling up our jails what the hell? if we don't get involved we deserve what they do to us when they finally take our last right away in the name of national security.

OK, son, you failed to mention an assault charge here,why? You talk about sueing (is it $$ you want?) If this guy did what you say, he should be in a cell, so I gotta say that the cops obviosly don't believe this account, ergo, no case. Give me more if you want help.

If you're concerned that the DA isn't taking enough notice of your case, have you considered going to the press in order for them to pressure the DA into further action?
