If my baby daddy is into alcohol and weed would the judge do it without visitation?

YOUR responsibility is to INFORM and provide as much evidence as possible (including arrests/convictions of the alleged father) PRIOR to going into the court to ask for Child Support and Visitation Scheduling.

The judge will most likely order a Drug Test -- and if it turns up positive -- will restrict to Supervised, Monitored Visitation with the child for the alleged father.

Child Support will be ordered for the biological father, and it is based on % of time of visitation, and based on the combined income/number of children/your income % in the calculation.

So yes, Child Support will be ordered, but you will most likely have to deal with SOME form of visitation being ordered between the father and the child.

Well Visitation and Child Support are two different courts. He can be made to pay child support without any visitions even established. He has to file for visitations. And here in Ohio thats 2 diff courts. Also if he smokes and drinks you might want to request supervised visits. That way you or another one of your family members will be there when they visit. This is best for the child if they havent been arround each other much anyway. Good Luck

You are going to have to prove it. Your word alone is not going to be enough.

Again as I said in my answer to your last question about this, this is the reason why people need to think about what is to come if they have sex with someone, especially if they are not in a long term commited relationship or they are having a one night stand.
By you referring to him as your "baby daddy" that shows that you probably are not married, engaged, or were in a long term relationship.

I would have to ask this, was he not doing these things before this child was born? I would find it really hard to believe that he just started this behavior all of a sudden. So if that is the case, why would you allow yourself to get pregnant by someone like that? You are guilty of putting yourself in this position. You should have considered the consequences of your own behavior as well. He may be a drunk and a dopehead, but you are not the victim in this situation. The child is. You don't need to try to just out right keep the child from this man, but you need to request that he be drug tested and possibly have some type of alcohol or drug treatment.

If you can prove it, the judge would probably require supervised visitation. But no judge will say there is NO visitation, unless child abuse is proven.

You would have to prove that he is unfit. Does he have an arrest record or convictions? Even with a record, he could still get supervised visitations. Definitely consult with a good lawyer.

If you can not prove it then ask for a drug test on the spot at the next court date. Also offer to submit to one yourself. If he has a past history then request police records before court or ask when you file for him to furnish a copy of his police record. This will only work if it was recent.

i think the judge will set you child support and his visitation right will be supervised
