Since the amount each worker lost was low, if only the 4 original sueing employees could be represented, the case wouldn't be worth the attorney's fees to take it to trial.

Now it is.

It is a procedural ruling and doesn't decide if Tyson was guilty of racketeering, but it means there will be funds to get to the merit of the case.

The alegations are that they knowingly used agencies to 'buffer' them from hiring illegals directly.

N- yeah, that is my biggest problem with class action, too. The named plaintiff may get real redress but the rest of the class typically has to settle for change of policy going forward, and a handful of peanuts, at best. Still, change of policy would be a good thing.

I used to work maintenance for one of these packing plants, and I seen what goes on inside of them. The idea behind hiring illegals is so they can run down the price of wages, plus they are disposable, they can fire any one of them, at any time , and for any reason.

They know they are illegal, and they don't do anything to block illeglas from getting hired on. They are guilty of employing illegals, they know it, we know it, but they are not going to admit to it.

I think it's great. Go after the employers anyway you can. That will solve the immigration problem. It's simply a matter of supply side economics. The jobs go away the illegals go away. How do you make the jobs go away? Go after the employers.
After the election you won't hear the politicians talking much about immigration, anymore. Might as well go after the employers with class action civil suits. If it effects their bottom line it may stop them from hiring illegals for depressed wages.

I just don't like seeing lawyers get rich off this. I think Tyson should be fined big time, and the money should go to enforcing the immigration laws we have. Let them be made an example of...

i think its about time and i do think we will see a lot more of these cases i also think if the illegals get amnesty we will see more case's where they will be asking for more money , and back money for being paid low wages except for the ones who were paid under the table they will be crying
