my wife and i have been seperated several months, she has been on public assistance, and i havent yet been ordered to pay child support. we are now going through a divorce.

Yes, if she is on assistance. Why are you leaving your kids with her and not paying child support? You will owe child support plus the state will go after YOU for all the money that she is getting got food and you will also have to pay the insurance for the kids. They will go back to the time that your divorce is finalized OR for the first day she applied for assistance.

Are you helping out with your child now? If not, you should be. If you just split, that still means she needs money to take care of your child.
Most likely, I am thinking you will get stuck paying money for the past few months, but if you take the initiative and show you are a good dad and give her money and spend time with the child, the courts may go easier on you.

My experience was that the date that child support is due was determined by the date that the court or the consent decree or settlement etc names the amount you are supposed to pay.

Example; I divorced Feb 02. We didn't settle on childsupport and property til July 02. He now owes me child support from July 02 to the present. but that's another story......

Of course U will Silly she's on State Aid so you'll be going 2 court 4 that really soon or the state will attach your pay check.Good Luck

most probably yes. If your smart I'd start saving a little now so when things get finalized you can give her some money. They will make your first payments larger to balance back payment, so that its not finacially tight for you then save now

You might so save. And if I might add, never, never give cash. It doesn't count. Make checks or whatever so you have records.
