I recieved my first ever speeding ticket for going 44mph in a 30mph zone in New Jersey. I don't believe i was going that fast. What should i say to the judge to prove my innocence? Also, Let's assume I was speeding (hypothetically), What are the best ways to get out of a ticket?

If it is your first ticket (Your license is clean) hire an attorney. He'll get it reduced to a non-moving violation without a problem. It is not the cheapest way, but it will work. You could appear yourself, but the deck is against you. The cop schedules all his tickets for the same day of the month, and unless he blows all of them off, he is going to show. If you go that route, you better have some legalese to spout at the judge. Things like asking for proof that the gun was in calibration, that the officer has had certification/receertification on that model, etc. A lawyer knows what all these little things are. And they have to be able to produce them. But if they can't, the judge will probably grant a continuance til a later date so prosecution can produce them. If it is just you, the prosecutor will keep this up, and it will drag on for a long time, and again the deck is against you. But the prosecutors and the defense lawyers all know each other, and rather than go through all that the prosecutors will just offer the defense attorney a deal to spare all the BS.
Quick word of advice: Paying a lawyer sucks, I know, but it is worth it. It will get handled right. You should fight every ticket, because you never know when there will be one that you can't get out of. And they usually stay with you for three years, and if you have a blighted record, they are more apt to slap you with the next one. I'm a trucker, and I've had a number of tickets, and I take no chances with my license, cause I need it to make my living.

Look at your state statutes. In Indiana speeding is an infraction. That basically means that the officers word is accepted as the truth. Honestly, you probably were going that fast and didn't realize it. None the less, in Indiana if you go to court to try to fight a speeding ticket your gonna say "I wasn't speeding" then the officer that wrote the ticket is gonna say "Yes he was" then the judge says "guilty". You'll pay your fine as well as additional court costs and probably get some additional points taken off of your liscense. The only way you could get out of it is if you had some irrefutalbe proof, ie: video tape that somehow proves you weren't speeding. If you don't have that, just pay you ticket.

I think you have to go to trial to "prove" you are innocent of the charge -- and then you must be prepared to prove it. You could ask the police officer, in court, when the last time it was the meter which measures speed, was calibrated for accuracy. I don't know too many people who have gotten out of a speeding ticket. But if you go to court and pay the ticket, you should be able to get supervision so that it doesn't show on your driving record.

If you are willing to pay an attorney a fair sum of money, then you might have a better chance of getting out of your ticket. Attorneys know the law -- and have the best chance at presenting your case.

Call the Clerk of the District Court and find out who the county or city attorney (the other side's lawyer) is handling your case. Call that attorney and ask to plead the ticket down to a lesser violation. You won't get out of the ticket, but it will be less points on your driving record. You will probably have to pay the full fine, but in the end it will be cheaper than hiring a lawyer to argue your side of the case and the added points to your license which will raise your insurance rates.

There really isn't a way, unless you want to get a lawyer to fight for you. I live in New Jersey also and the courts are awful.. I was in a car accident that wasn't my fault.. and they let a woman sign a complaint again ME! When she was at fault. So I signed on against her. Then, we both pleaded the 5th and nothing happen. I had a laywer and so did she.

The courts want $ .. thats it

on a date ( before the due date)
go plead the case in front of a magistrate ( found in the ticketed city court house)
you pay the fee... in return you get NO points on your record
so car insurance will not go up

The only real chance you have is to get an attorney. It is cheaper and less trouble to admit guilt, take defensive driving and move on.

take it to court give ur half of the story. tell the truth. they might go alittle easy on u,... and besides its just a speeding ticket.
