This individual does have a criminal record, would that make an organization's request for letter of police clearance valid? In other words, would it be possible for an individual to obtain a letter of police clearance considering that they DO have a criminal record?

It is perfectly legal for a potential employer to request a Letter of Clearance. When employment with the company requires contact with confidential or personal information, or perhaps handling cash/credit cards they will want this information.

A "Letter of Clearance", however, is NOT a background check. Rather it is a letter stating that as of that date the person does not have any warrants for their arrest, outstanding fines, or other judicial actions pending against them. This does not include information about past arrests and convictions.

Yes it is possible. If an employer or investigator sends a request to an agency for a background check, they are only going to get a check through that agency's database and not the county, state or country. So if they had a record elsewhere, that may explain why they came back clean.

im not sure about US law, but in the UK , any citizen can apply to the policeforce for a certificate of clearance, we call it an enhanced disclosure, teachers, people who work in or with people who are vunerable, even a publican must be cleared, LF
