we live outside the city limits so we aren't required to chain our dogs up. they are just friendly farm dogs that are allowed to roam free.are we obligated in any way to this person?

I don't think so. If anything, they are responsable to *you* for the death of your pet. Where did it happen? You mentioned a farm, was it on a "private road"? If so, you' ve got *them* for tresspassing and the death of your dog

That's up to a judge or jury, but there's a good chance they'd say yes, depending on the circumstances. If you were allowing your dog to roam free and you live near a road there would be a reasonable expectation that it could interfere with traffic and cause an accident. That's what the other attorney will say, at least, and I think a jury may feel that way if they aren't all animal lovers. It could really go either way though.

Even though you live in the country, there still might be a leash law or a law that makes you be the responsible one to keep your dog behind a fence on your property. You are responsible for the damage. Your dog caused the accident, who would be responsible if it was two cars in an accident?? The one that caused it.

I say yes.
The accident would never have happened if you had kept your dogs locked up.
I think you should pay them.
I'm sorry for your loss, but I hope you learned your lesson. Another term for "friendly farm dog" is roadkill.
Becides, it's the roaming dogs that cause the most havoc. I've seen "friendly farm dogs" maul cats, and kill other animals.
For heaven's sake, lock up your dogs.

Sorry to hear about your dog.

If the dog was in or on your property, then your not responsible, but it out on the street, you may be responsible for any damage to a car.

This is dependant on state to sate or country to country. So I would check with your local bylaws (council or police), as they will be able to give you the correct answer.

The driver of a vehicle should always be aware of the road, and what's on it. If you've been warned before about your dog being on he road, he might be able to use that against you. I think it would be up to his insurance company, otherwise I would think that you held no responsiblity in the matter. He sounds like he was being a careless driver. Sorry that happened to your dog.

You are responsible. Same thing if your dog would have bit someone or dug up someones flowerbed. You are responsible for it and its actions. Allowing it to run lose on your property sounds fine but allowing it to be able to run around on the road and though other peoples property? That is not right.

Yes U R the dog shouldn't of been in the street.What kind of damage can a dog do lol.The guy kills your dog & wants u 2 pay 4 his car I truly wouldn't..let him bring u 2 court you'll win I'd say he should of been more careful.Good Luck

you could very well be held in contempt. It depends on the area an if or if not you have an existing leash law.. Good luck.
