Your question could be interpreted 2 ways=
1-you are parked in a drive way and the police drive by=
If you are drinking or obviously intoxicated and if the keys are in the ignition and you are in the drivers seat-yes they can.
It does not matter if the car is running or not or if you are on private property or not.
2-Police car is sitting in a private drive and you drive by-
if the police suspect you of something yes they can pull you over.

I think it does depend. If you look like you are doing something weird or you match a description of someone they are looking for - well, then you are out of luck. You are in plain, public view - so, say, you were fooling around with your girlfriend - guess what? You're indecent in public.

If it were a minor traffic violation, I don't think so - BUT I have been told they are allowed to cite for expired tags of cars parked in driveways because it is assumed you intend to drive. (If you have a non-operational vehicle, you need to park it out of site, or register it as such - depending on your state.)

Well, it happened to me. Luckily he let me go with a warning. Guy was way up on a driveway...I don't know if it was his, a friends, or what, but you couldn't see him until he painted you with his gun.

Just suck it up and pay the fine and go to traffic school or whatever you have there.

Depends on what you were doing. If you were selling drugs from your car, of course they can! If you made a turn into your yard from your driveway without a turn signal, of course not!

What most Americans seem oblivious to is the reality that we live in a "police state", which means that the police will do just about anything they please. (Read Orwell's book titled 1984).

It is much easier (and financially prosperous) for police to make trouble for honest and generally law-abiding citizens, than to look for and arrest criminals.

if you were doing something illegal, absolutely!
if you had been doing something wrong, absolutely!
if you were just sitting in your own driveway, minding
your own business, and had not done anything wrong
and there were no warrants out on you, then i need
more information.
