get arrested in md back in 98 for dist the peace, bailed out, never went back to md since- is this still in the system

When you said you paid the bond, do you mean you paid the entire amount? If so they may have received it as bond forfeiture and found you guilty in absenia. Call the clerks office and check on it. Most of the systems keep it on the computer for at least 10 years so yes its still there. Don't worry about calling its not like they can arrest you over the phone. Tell them you want to take care of it and what would be the best possible way. Believe me its not a big deal the clerks will be very helpful to you.

The people that are telling you the statue of limitations is 3 to 5 years is wrong. It will only show up on the driving history in MD. Its a misdemeanor that is why it doesn't show up in other states.

Many unanswered questions, but probably good news for you.

If you got arrested in 1998, you MAY have been criminally charged. You could have simply been issued a "municipal court" violation, in which case, your bail was probably applied to the fine, and you are safe.

Second. If you WERE charged, there is no statute of limitations, since your paperwork told you when to go to court. Statutes of limitations only apply to the commencement of a case, not to how long it takes you to respond.

Even if you were charged criminally (which is a 50-50 possibility), you can probably get this all taken care of for the cost of the fine plus a few hours of an attorneys time. Probably worth it for you to stop worrying about it.

Just read previous post -- good advice there. She's right, the clerks will help, and if you need to do anything, they will tell you what to do.

It's definitely still in the system. There may be an arrest warrant out for you. The statute of limitations only applies before prosecution has started. By arresting you, they started the prosecution and there is no longer a statute of limitations.

Yes of course it is. They have records of all arrests. I got arrested for a DUI, was released the next day (this was a long time ago) but the DA never pressed charges because I was under the legal limit. To this day if I get pulled over, cops still ask about that.

It will still show up on a criminal background check, that has nothing to do with the statue of limitations, they just can not come back and take you to court over it. Unless you didn't appear for court, and they issued a warrant for you, then the case is still open.

good chance its still on the books for another 3-5 years. Youll find out when its time to renew your license
