Yes. From what I understand.... if you're blood alcohol level is above the legal limit and you are behind the wheel of a motor vehicle you are eligible for a DUI. So, if you're going to sleep it off in your car, crawl into the back seat!

DO NOT!!! AND I REPEAT DO NOT!!!! HAVE THE KEYS IN THE IGNITION.And even better yet,sit in the passenger seat tilted back,or lay down in the back.Just make sure you're not parked ANYWHERE that is going to be a bother.BUT...the best thing is to have a designated driver,or call a cab.The police are getting less and less understanding,even if you are trying to sleep it off on the side of the road.Too many people think that after a couple hours,that they're okay,and you really aren't.I don't have any sympathy for drunk drivers,but at least you are trying to not drive while drunk.The problem is going to be if an officer drives by,and sees you passed out,they'll take your license # down.They'll keep coming by to see if your car has moved,and if they catch you on the road you will still blow drunk.It takes more than just sleeping to get it out of your system for you not to blow over the limit.And the thing about coffee sobering you up,is B/S.

P.S. But PLEASE don't drive at all if you've been drinking.It only takes one time to change you and possibly someone else's life. God bless

Depends on each state but from my understanding if you are intoxicated and are behind the wheel with possesion of the keys or the keys in the ignition (even if the car is not on) you can be arrested for DUI. My advice is don't drink and drive, instead drink and walk, drink and ride in a cab, or last resort, control your drinking. If you think you need help, GET HELP! I've lost to many friends to DUI related accidents.

If you are anywhere in the vehicle (even in the back seat) when you are by yourself, with or without keys in ignition, you may be picked for a D.U.I. If you are on private property (your driveway, a friends' driveway, your parent's house) you can still get busted. Always remember....if you are planning to pass out in the parked car, make sure it is off the road and the keys are NOT in the ignition. If the keys are not in the ignition and you get in trouble for a DUI, you can fight it.

If you are in the driver's seat, yes. If the keys are in the ignition and you are in another seat, yes. If you have the keys in your pocket, and are laying in the back seat, you might get a ticket for a DUI but you can beat it in court. If you are in the drivers' seat passed out, you will loose in court. If you have the keys in the ignition you will loose in court.

If you are the only one in the car, and are passed out in the back seat, and the car is at a place other than outside the Bar you got wasted in, you will have difficulty proving that you did not drive under the influence.

But passing out in your car while you were planning on sleeping it off, is quite alright, so long as you are not tresspassing on the property you are sleeping in your car.

Yes. I actually had a friend who was driving home and realized that he needed to pull over. He stopped his car, and quickly passed out. The next thing he knew, the State Police were knocking on his window and he got a DUI... the argument, you had to get there somehow, and you were in the car with the keys in the ignition - plus, as soon as they got him out of the car, he failed the sobriety test. Bottomline, don't drive a car if you've been drinking.

DUI or DWI, depending on the state you live in. I knew a guy that was sleeping one off in California and the police knocked on the window and because he had the keys in the ignition he was arrested for DUI.

in california, you can be charged with a dui in that circumstance.

in traffic school, the teaching officer even told the class that possession of keys is not the sole issue. he told us that even if you throw the keys outside your car and pass out inside your car, you can be charged because you knew where the keys were. i'm sure that will be up for debate.

It depends on your state of residence.

In New York, as long as the keys are in the ignition, you are technically driving, so you can get a DUI or DWI even if you are sound asleep in the backseat.

DUI only applies for people who Drive Under the Influence. or in other words: drove when drunk. passing out from a completely different health reason won't get you a DUI. it'll get you an ambulance. =)
