Its a messed up thing. because if fists were flying then both can file charges. the self defense comes into play into courts after your in jail. How do the cops know it was self defense? Even with witnesses they take em to jail. its messed up. just making sure that the person instigating the fight doesnt get away with it. so they arrest both. Plus they need to meet their quota and have our taxes pay 25$ for a bologna sandwich with no condiments and stale *** bread err umm so i've heard

Probably because the one fighting in self defense cant prove it, or wont walk away from the situation.

In most cases the cops avoid taknig in the one who was acting in self defense. But figuring out which one that is can be rough.

Probably for documentation. Most likely someone (or both) will cry self defense when it might not have been the case. So maybe they feel it's just safer to take them both in and sort them out later.
Just a guess.

It takes two (or more) to fight and people tend to point fingers calling the other person the culprit. Both must go to jail and then it can be decided on by a judge.

Not all states have a "self defense" law. I know Oregon and Idaho will throw both offenders in jail, regardless of who started what because they are both at fault.

Because a battery occurred and to prove you are fighting in self defense is up to the courts.

It sure seems like they do and that's hardly fair! I think it's because alot of the time both parties are drunk and they can arrest them for public intox and disorderly conduct as well. Also, if there are no unbiased witnesses, they can't tell who started it so they arrest them both and let the judge decide. However, I do think sometimes it's a clearcut case like a big sized guy beating his smaller sized girlfriend.

It's called mutual combat...both go to jail, even in self defense.

Example 1
wife slaps husband and husband slaps back..mutual combat
(if cops are called both could go to jail)

Example 2
wife slaps husband and husband breaks an arm with a baseball bat...husband goes to jail.

The cops can't or won't take responsibility for judging who is at fault unless it is very obvious. They let the courts decide. It's not fair sometimes but keeps them off the hook for making a bad decision. They don't want to be sued!

I just heard this at work yesterday. I guess now a days if its domestic and there are marks on both parties then they do.

If only one has marks and the other one does not maybe the cop is lazy.
