He's from Bangladesh and we're trying to get him here faster by applying for the fiancee visa.

You apply for the I129f. You are the petitioner. You can download the form at www.uscis.gov. Fill it out and send out with requested amount. Expect 6-10 months b-4 he is allowed into this country. I'm not sure what you mean by getting here faster by applying for the fiancee visa. The officer that interviews him will make sure that the relationship is a 'bonafide' relationship. You will need to prove, beyond a shadow of doubt, that you are in fact engaged to be married. If you cant, he can not come into the US.

Go to the US Consulate Office in Bangladesh and apply for a K-1 visa. If approved you have 90 days to get married once in the US. After that another 90 days to apply for permanent residence via I-130 petition, CR-1 classification.

You could get an immigration lawyer, but it's not necessary if you're good with filling out paperwork. You can figure it out if you research on the web and the INS website. Using INS resources alone will not get you far because their instructions are not complete.

I did it myself and the K1 visa went through fine. Just be aware there are filing deadlines for various papers. If you miss one, you start all over again. And, make very sure your checks to pay for filing fees DO NOT BOUNCE. Another headache.

One other thing accuracy is very important. Always make sure names are spelled the same. Addresses match on various forms. The name you put down on the paperwork is the name that will show on your green card. My wife had a problem with this because there's no indication that we should use her married name (since we were fianceed), so we used her maiden name. That was a mistake. We had to go through trouble to get her card reissued and meanwhile they confiscated the old card, so for the first year she could not travel out of the US. And, when we did travel they flagged her green card as being suspicious because she had 2 cards issued within 2 years. Caused a hold-up in LAX.

One other thing, if your local immigration office lets you setup an appointment when you need to go there, then setup the appt ahead of time. Otherwise, you'll sit in the waiting room for hours and if you're late, you won't be seen.

Also keep an exact copy of everything you send to INS. You'll regret it later if they lose something.

Hi,

First of all, you must be a US citizen to be able to petition for your foreign fiance.

Secondly, you must have met him in person within the past 2 years (and have some proof of it, such as, photos, tickets, itinerary, etc).

Thirdly, you must be ready to marry him within the 90 days of his entry to the United States.

The correct way to start the process is for you to file the petition I-129F with the USCIS. The petitions must be supported by lots of documents and accompanied by few additional forms.

Usually, it can be approved within 3 to 5 months.

Then, it will be forwarded to the US embassy in Bangladesh, and they will contact your fiance directly (mail him the packet with information and instructions for the last step - a fiance visa interview). Total time frame could be from 5 to 10 months (depending on many factors).
