Yes he is, he is allowed to go out and graze for awhile. He should pull out of it.
Don't forget Bluegrass Cat, the horse who ran against Barbaro at the Kentucky Derby and came in second also suffered a broken hind leg in a different race and his career is also over.
Two great horses I'll never forget.
