If a person's VISA is out of date,
and if the person's I-12 status is valid
via a school, then he/she can legally stay in US?

There is no such thing as an I-12.

If you mean an I-20, the answer is yes as long as he/she is still a full-time student at the same school indicated on the visa. A visa is only for entry into the US, not for length of stay. If he leaves, though, he will have to use the I-20 to apply for a new F-1 visa.

I would have to say, "No"; but, then, I'm not positive what an I-12 is. I know that a Visa must be renewed, but not if an I-12 takes precedence.

Check with the local Immigration and Naturalization Service.
