Okay ...where do I begin? ... about 4 1/2 years ago.. My boyfriend was wrongly accused of raping a young girl. There was no "Evidence" it was all circumstantial and hear-say. He had a lawyer, but later found out, after the lawyer took off with the money, that he was not barred. Now he and his father were in a situation where they didnt know what the heck to do... you have a young girl saying that this man raped her, your lawyer runs off. and your AFRAID your going to get hit with hard time! Now he and I as well as his family believe that there was a group of men or "boys" that had a vendetta against him. He was framed, I know that it sounds like hes saying what every other man who is or went to prison is saying. but this is not one of those cases! He went to prison for 2 years and was let go.. for RAPE mind you! They did not take blood! he was detained for 3 days before being "arrested" and now he is the Sex Offenders Registry..please he needs his life back youranswers are appreciated

You are absolutely right... 2 years locked up and 2 years parole. No they did not admit they made a mistake... he took a plea because he had no idea what they would do. We talked to a couple lawyers and they told us that there was really nothing they could do because he gave up his right to an appeal when he took the plea... so we dont know where to turn. or what to do. Its injustice! and it took 2 years of a mans life... Another thing this took place in Detroit, There are so many rape cases there they don't know what to do with them... I am telling you it would mean so much to us if you could help or advise on steps we can take.... Thank You.

He was linked tothe crime because he was in the same house it happened at.. It was a party.

he got to the police station by means of the girl "victim" and her mother .... he went to "supposedly" Identify the girls friend and that is when the mother started cussin and screamin sayin that he raped his daughter abd they detained him.

the only thing you can do is get a real lawyer and a private detective agency to look into the whole thing it's going to cost you money but other than that you have no other recourse. the lawyer can file appeals if their are grounds for an appeal. usually when you cop to a crime you give up your rights to an appeal. so make sure he can appeal before you spend money. get a consultation from an appeals lawyer. he will point you in the right direction. other than that you will need to get a pardon from the governor or the president and that is not going to happen.

First of all, circumstantial evidence is still evidence. It can be used against a person. Look at Scott Peterson, for example. All the evidence that proves that he murdered his wife and unborn child was circumstantial. He was rightfully proven guilty through that evidence.

Second, your boyfriend can't get this off his record. He took the plea agreement, which was him admitting that he did the crime. Since he admitted, he has to take the terms that he agreed to in the plea agreement. If he had been found guilty in a trial, he might have recourse since he could press of DNA testing of any evidence. Since he agreed and admitted, as part of the plea agreement, that he committed the crime, he can't go back now and say, "Oops. I changed my mind."

It's probably too late to sue the original attorney for malpractice.

No judge will convict anyone for any crime just from hear and say.You said they done no blood.When it comes to DNA they will only take a blood test if the victim has blood on her other then hers.They will go for hair and skin samples.He was detained for 3 days before being arrested? That sounds about right.After 3 days and no arrest they have to set him free.Im sorry they are not just gonna convict him of rape with no evidence at all.You may not want to hear this but they had to find something to link him to the crime.He is lucky to have you by his side.

File an appeal/sue.

And get a real lawyer.

And why'd the release him so early? Rape is much more than 2 years, parole isn't likely until 7 or 8, did they admit they made a mistake and hes innocent? There's a lot of information you aren't telling us....

Sounds like he was not only arrested but convicted.

Sounds like he took a plea deal....that's why he only got/served two years....perhaps they reduced the charges...who knows, you are not giving enough info to comment on that.

Why would a "young girl" want to frame your bf?..or even better, it was a group of young boys that were out to get him.....sorry but I'm not buying that one.

They do not need to take blood...there are other ways to get DNA.

Too bad b/c IMO....it should stay on his record.

My advice-don't walk towards the door...RUN....and never look back.

Sweetie, he pled guilty and copped a plea. There is no going back. You cannot rewrite history.

Sounds like he knowingly and voluntarily pled guilty. Can't really go back on that now can you?
