I was involved in a car accident today and was cited for careless driving which of course I am trying to defend. I ws driving southbound on a major state hwy, when I came upon a stop van going to turn left. I was looking down at my speedometer and was going the speed limit also I had a lot on my mind and was thinking . I think either the van had pulled in front of me or her turning signals were on. However, I cannot recall everything. My question is a police report was done and the lady confess she had her blinkers on and I said I never saw her. Can I get rid of the is ticket and not have my ins. or this on my record. Where is the proof? any advice appreciated. Thank you

All of you were wrong!!!!- I went to court and it was figured to be a freaked accident. Best not to judge someone if you don't know the laws or what you can get away with:) Accidents happen and no way to get aroung them. We are all human. I was wrong to figure there would be somebody that would support me. Sometime look up wierd laws in your state and you will find out.

Pay the ticket and take the Safety course and our points will not be assessed (in Florida). I just do not think you will win. If you hit a car from behind In Florida, and most states, you are at fault, hands down. Sorry

You came upon a stopped van going to turn left. You were looking down, had a lot on your mind and was thinking.
You rear-ended the van. Your fault.
You weren't watching traffic. Your fault.
Your head was occupied on other thoughts. Your fault.
Regardless of the vans turn signal on or not, you're supposed to be fully aware of what's happening around you at all times and you weren't. So, yeah, careless driving. Tail gating could have been a contributor also.
People can stop in the center lane of a major highway and you're expected to avoid them. It isn't legal that they stop, but you're at fault if you hit them.
I don't think you'll win in court, but get a lawyer and see if he plead it down to a lesser charge. Pay the fine, take the course and be happy that no one was injured in it.

If you broke her tail lights...it will be very easy to tell if she had on her turning signal....the filiment in the bulb is WHITE hot when blinking, if you stroke it and broke it while the filiment was hot then the filiment will be twisted and look like a curly fry from Arbys and will be heavily oxidated....if you broke the light while it was turned off, it may or may not have broke, but will have ZERO oxidation and will not be curled up....

this is pretty basic Traffic Accident Investigation that any cop "should" know....ask for the police report, take pictures, ask the police to re-investigate if they did it improperly...

on the other side..if you are lying about your speed, they know that too from basic traffic accident invetigation school, so don't lie...you'll look like an idiot in front of the judge...

First, I am assuming you rear ended her. If you did, it will be your fault. Just the fact that you told the officer you never saw her won't look good. I had an a car accident that I fought in court. I won, but only because the officer who was at my accident did not show up. Due to his absence, the ticket was dismissed. I think I would have lost otherwise. Sorry, that I couldn't be of more help.

What is it exactly that you want to hear?
I wasn't at the accident and don't know what happened or even if you're description of what happened is accurate.... how do you expect me too predict the outcome?
If i were a judge and somebody came before me and said that they had a lot on their mind, and couldn't recall exactly what happened I think I'd make their ticket stick.

OK, think slowly it was your fault! You took your eyes off the road even if it was for a brief second and you were not concentrating!
Pay the fines and/or costs consider it a lesson to never get behind the wheel unless you fully accept the responsibility of what occurs when you are involved.

Who ever was turning LEFT is at fault. The proof is turnsignals light bulb and tire marks on the ground and pavement (Like did you try to stop? Did someone pull out in front of someone into on-comming traffic?)

I'm sorry, but if you reared the van, it's your fault. Pay the ticket and like another said, be glad no one was hurt.

if you hit this person in the rear youre at fault no matter what. you where tail gating which is against the law.
