my son is 9 years old and his father has seen his son maybe 10 times in his whole life thanks 2 me. He never had time for him his entire life. He even moved acrossed the us from him. he wasnt even around when he was born. Now all of a sudden he wants custody of a son that he doesnt even know and is trying 2 use his position 2 get custody of my son. I am a great mother, im educated and he has everything right where he is. His father does make more money and hired a lawyer and he had me served with papers write after my mother died and the day b4 my birthday just 2 b evil. What would u do?

in addition to this i have tried 2 set up visitation with him he wont meet me half way. last year he had him out of state and refused 2 bring him back and i had 2 get the da involved, he missed 2 weeks of school, they told him he had one week or he would b charged. he did bring him back.. I have tried 2 give him visitation again he wont have an adult conversation with me.

The courts will not take your child away from you unless there is a valid reason. However, you also need to understand that the court will also give the father visitation rights and possibly partial custody. While this may not seem fair to you, it is in the best interest of the child that both parents be involved in a childs life unless there is a valid reason for this not to happen. Unfortunately, your ex filing paperwork on the day before your birthday won't be seen as a valid reason to keep him from a relationship with his son. My advice would be to hire an attorney and try to work out an agreement with him so that he has some visitation rights but also demand child support. Just because you have issues with this person doesn't mean you have the right to keep him from a relationship with his child.

child custody is a civil issue.
