The initial claims definitely point to the fact that the pilots were at fault. The question is why. Was there a language problem? Misunderstanding. Was a gauge faulty and giving an incorrect reading to the pilots? Was the proximity detector turned off. Why didn't the Gol plane detect the smaller plane?

I would have to wait until all the evidence is in, but the truth is it doesn't look good for them. It's a sad mistake that costed many people their lives.

hard to tell, If it was a chartered Legacy then I'd bet its thier fault. If it was privately owned then I'd say it was a misfortunate event.

Apparently there is or was a "Bermuda Triangle" type of spot in the amazon which affects Radio communications, so I dont know if that affected their decision making.

the plane's transponder was shut down... ground contacted them 5 times but radio turned of.... they were 1000 feet higher than they were allowed so yes they were guilty
