I've been hit but an uninsured motorist and the insurance company is the one that's suppose to fight for you to get him to show correct insurance information but let me tell you nothing was ever done in my case. You still have to pay the deductible which sucks but at least your car is fixed.
This is also the reason you always call the police for any accidents so they can give them a ticket for no insurance.

If that had come out at the scene while the police were there then they would have taken care of it. But they won't do anything after the fact. I know it isn't fair, but trying to make trouble for someone just doesn't seem worth if it your damages can be taken care of. Besides, when your insurance company decides to go after him for reimbursement that should be better punishment than the ticket.

If you ahve any information on this guy you can fill out a police report and he will be charged for driving without insurance and get his license suspended or revoked. If you have Unisured Motorist portection this can be helpful to you so you don't have to claim it on your Comp or Coll and pay a deductable. Check your policy.

File for damanges in civil court. You can file without an attorney.
I think damages cap might be around $ 5000 for this court.
It is a county court matter. You have to pay to serve the warrant and go before the judge.

If you have full coverage: your insurance company will cover all damages and will go after that person. If you have liability only you can file small claim if damages less than $5,000.00 or hire an attorney if damages over $5,000.00.
