In Connecticut, selling a 92 mustang with an off road H-pipe installed. I have and will provide the stock H-pipe to the buyer. Other than informing the buyer that an off road H-pipe is installed (which I will put in the car ad), do I have any obligation to the buyer in terms of lemon laws or a possible lawsuit?

I will make it clear in the car ad that the H-pipe is for "off road" vechiles only.

Off road H-pipe = will FAIL emissions in most states.

well... it will be nice of you if you reveal the problem to the buyer. but it is still the buyer's responsiblity to check before purchase your car by having qualify mechanic to check the car... But if you sell the car "as-is" on the contrast that should release any future obligation. Make sure in bald letter or underline. and make sure the buyer is over 18!! Because you cant have legal contact with person who is under age.

You are squarely in a gray area. If you knowingly sell a car with a known defect you may get sued in small claims court for fraudulent representation. Now, you may prevail as the buyer has the responsibility to check the car out before purchase. But, if a judge believes you actively hid the fact that the car will not pass inspection, and it could be argued that your knowledge of the modification would give you this knowledge, and you should have been responsible and pass this along to the buyer as a known fact.

Also, it is not O.K. or nice to not tell the person buying the car abouth this.

Lemon laws only apply to new cars.

No you don't have to tell them, though it would be nice.

It is nice that you've got the stock h-pipe to give them because those suckers ain't cheap from Ford.

Caveat Emptor, most people shopping for a Fox 5.0L expect to put money in them, even the newest ones are 13 years old already.

Make sure you state that the vehicle is AS IS, and certainly do not state that the vehicle WILL pass emissions testing, otherwise you should be fine.
