I have 2 3rd degree assault charges from over a yr ago, a petty larceny charge from 2 yrs ago, a dui from over a yr and a half ago and now just recieved another dui. what are my chances of jailtime/penalties?

Let's say that you have taken care of the assualt and larceny charges. As they say in dui (what did you blow?). I am sure that you know that you can get ONE dui per every 10 years, but since you have two on your record, I have heard that the fine as well as jail time (if any) is calculated by the level of alcohol anything over 0.8 is legally drunk and you probably will get a 9 month- 18 month program with no jail time (or time served), You have lost your d.l.# for a year, and your sr-22 insurance will now be about triple that you normally pay, and that goes on for 3 years.but, after your first dui they put you on 3-5 year probation, so you have now broken your probation. I hope that you get a lenient judge, and a great lawyer.And I hope that you have taken care of all your legalities up to this point. One more dui and it is automatically 1 year in jail, plus 18 months of dui school

What state? Many states have enacted tougher penalties for second and subsequent duis. It may also depend on how much over the legal limit your intoxication was and other factors. If the assault and/or petit larceny charges involved alcohol, expect more than just fines.

It all depends on where you live and what their laws are. My dad had like five or six DUIs, and he only went to jail ONCE for ninety days! I thought that was ridiculous!

I personally think that you should be in jail. Although you are going to be leeching off of us law-abiding, tax-paying citizens either way you go.

Maybe you should clean your life up and see about walking the straight and narrow. Although I doubt that would ever happen. Most people who are felons never change though.

I think laws are written in DUI cases that have little to do with your other issues!

Usually a DUI 2ND carries jail time!

You should get your act straight, get off the booze and get into a 12 step program, unless you liked being punked in prison!

Different states have different laws for DUI. Most states for 2nd DUI will require at least a couple days in jail.

your lucky I'm not the judge you'd be in jail already so you couldn't get the latest DUI however thats my opinion in reality your not likely to get any jail time but maybe community service and some large fines judicial system in this country sucks always has always will until we abolish lawyers and start sending people who break the law straight to prison or to the chair to fry for what they did, none of this waiting or appeals crap you did it found guilty you go away or die end of problem

it totally depends on where you are. are you on probation or any post supervision? if you are and the judge is a hard a s s, then you're probably going "upstate" for a minute. its an election year and a bad time to go in front of somebody that needs votes especially with your record. if you are in a major city you might be offered some kind of substance abuse program if most or all of your crimes are alcohol-drug related. what ever you do, DONT go to trial with your record.... take the deal. you do not want to blow trial and do alot more time than you have to. trust me on that.

No sympathy here.
I hope they jack the jail up and sit it on your toes!
Put you so far in jail that they have to pipe daylight to you.
Here's hoping they rip your driving privileges away like a dentist would a bad tooth, and not allow you to own another car for at least ten years!

Since Johnny Cochran is dead, Here in Florida, you're going to jail. If you live in Philadelphia you might get a slap on the wrist.

in case you ask a similar question persistently lower back waiting for diverse solutions, there is something incorrect with that thinking. Already instructed you...you will bypass to penitentiary, on the grounds which you disobeyed the decide's order. - Stuart
