He is a non greencard holder. How is he going to be able to be with his baby legally??? I am worried.

having a child will not help his legal status. The child can only help his father get papers when the child is 18 years old. If you do not want to marry him, then the only way for him to be here legally is to come on a student visa. He would need to go to school and would not be able to work legally. If you decide that you love him and want to marry him then you can apply for a fiance or spousal visa...either way he will have to return to his home country to wait it out...a minimum of 5 months. It sucks, I know. I hope you find the solution that works best for you. You could always travel and live in his home country for 6 mos on a tourist visa.

Walk him to the border, kiss him gently on the cheek, kick his butt over the border an tell him when he goes through what the legal immigrants went through to become Americans, he can come back and see the child. Being a sire or breading stud does not bestow the right to live here. INS catches up with him, eventually he will have to go back. The three of you would be better off all the way around if he started the legal process now.

Just because he isn't a greencard holder doesn't make him illegal. If he is not here on a valid visa then thats illegal. His best option is to go back and apply for a proper visa and then apply for citizenship.

Don't worry, he is already here and nobody cares. Why make a big deal out of it? It's kind of cool because you can get all the benefits of a single mother without him. It would really piss off anti illegal racists here. Milk the system for your baby.

Isn't funny how most of the morons here assume your boyfriend is from Mexico. You didn't state where he is from. Just proves the depravity of these racist SOBs.

Sorry to hear about your predicament....

He needs to leave the country now and come back in legally, say through a tourist visa....After he is here legally, get married, and start the process of filing for status....You will need to produce about 3 years tax returns, showing you can support him.....The whole process will cost about $2,500 dlls. Its not impossible, and don't let these judgemental people, who think they have never made a mistake, make you feel bad....Please go to the INS office and get all the information and steps you will need to take, before you do anything....Best of luck to you...

Well, then you're either going to have to get him legal or move to his country, cause if he gets caught, they will deport him irregardless of who he knocked up.

that's the chance you took when you decided to have unprotected sex with an illegal alien..just because you marry a illegal doesn't guaranty that he will become legal..its much more then that..if you really love him them you have the options to go home with him..most illegal immigrants will hold on to American citizen for hopes of becoming legal and it doesn't work that way..
