Hi Anria, I thought about this question because I see so much anti Mexican stuff in here, I thought I´d provoke some real thought here, yes it is possible to have a premature "airside" birth even if Doctors/Airlines dont let Mums whom are pregnant fly in Jets at later than 5/6 months pregnancy!

If the captain of the airplane signs off on the report of a birth abroad and files it with the American embassy (or the DHS) where the plane lands, the child will be American. I am not sure of Mexican citizen requirements, but the child could also hold dual citizenship status as a Mexican.

well since schools don't seem to be teaching you anything - the baby is Mexican (because the dad is Mexican) and American (because the Mom is American) -boy that was a tough one.. got anymore?
Anytime a parent is an American their child is automatically an American citizen.. I'm guessing the same for Mexico- now some people can have dual citizenships and sometimes one has to give up citizenship from one country for the other... I don't know about that between Mexico and US

I think in this case the child could claim citizenship in either the US or Mexico. While the US does not routinely recognize "dual citizenship," other countries are fine with calling you a citizen even if you hold a US passport (e.g. Switzerland and Israel).

Also, if the parents split up and had a joint-custody arrangement, the child could conceivably claim citizenship rights from each parent's country of origin.

The rules of the countries of origin control. I believe that if the Dad is Mexican, Mexican law says the child is Mexican. If both parents had been American, American law would say the child is American. It may, anyhow, but I don't know.

The child is Mexican and ? Is the American Irish, Welsh, German, African? What?
Being born over the ocean doesn't make your child American or a Mexican unless you were in American waters or Mexican waters.

Hmmm, it would be in the childs interest to pronounce him American, (if he's Mexican, his American family wont like him) and since the mother is American and it's a US flight, there is enough reason to do so.

The baby is automatically a US citizen for having an American parent. I'm not sure how citizenship works in Mexico.

Well my geography has failed me. Pacific ocean. Is this a trick question. The mom Being American and they are unmarried so this child would not be legitimized by the father so therefore it would be American because the mom is American

Most doctors don't let very pregnant patients fly that late. Were they trying to make an international problem??

they should;ve looked at the map and see what place they were closer to and the baby would be from there if not..then the baby is Hispanic/American...
did this really happen? its interesting
