My name is kathy scott the name is kathy jones the address in in spencer. i live in midwest city. the amount is $1,500. for a southwestern bell yellow page add. By me not going sbc will be awarded the amount. will Kathy Jones be the one to pay? Or kathy scott that me.

Your served so what. You have the money to pay then pay, if you don't whippy doo dah day.
You can't be put in jail and you don't have to appeart in court. The Judgement of $1,500.00 will placed against you in your credit report.

IF it is not you, and the papers were served on the wrong person, that Jones woman doesn't live with you, then YOU don't have to do anything. Many court systems and lawyers, hire private individuals to serve papers. It is the responsibility of the plaintif to provide the correct information, and then the process servers responsibility to correctly serve the papers.

From the info you provided, it looks like they got the wrong woman, in the wrong city. Might be the same street address, but so what.

If you want to be nice, and do the right thing, make the phone calls and let the plaintiffs attorney know of the mistake - they paid good money to have that paper served. They might not care. The Process Server signed an afidavit saying they served it on the Respondant so they will go ahead with the case - unethical yes, but we are talking about lawyers here you know (Just a joke!). You might write a letter to the address the papers were supposed to be served at and let them know about it - their attorney would love it. You could also inform the Clerk of Court and show them that the papers were served incorrectly. Then if the Plaintiffs aatorney tried to continue with the case as stated above, well, let's just say that it would go over like a fart in church. Judge wouldn't be too happy that the Respondent wasn't properly informed and given the chance to prepare an answer.

You are not obligated to do anything further. You tried to inform the process server that they had the wrong place and they left the papers with you anyway.

A relatively simple solution may be to look on the civil papers for the name, address and phone number of the attorney who had the papers issued, then call and explain that their process server delivered it to the wrong person and the wrong address. It's something that an attorney will want to know. It serves him/her no useful purpose whatsoever, and also sets himself up for courtroom embarrassment, if he used the services of a process server - and the server is not sufficiently skilled or trained to do the job. By letting him know of the mistake, he tell the process server to go out and find the 'right' person named on the order.

The most significant way this suggestion could fall apart, is if there's more to the story than is written in your scenario description, and the missing part alludes to you being the correct person.

Sounds like "sewer service" to me. Most summonses will list the attorney's name who is representing the plaintiff. Call them and tell them that someone served papers for that case on the wrong person and as them what they'd like you to do with them.

You may want to contact the clerk of court where the case is scheduled to be heard. Tell them about the sewer service. They'll have a record of who the process server was and will take it from there.

You do need to let them know that it is not you. It is hard to prove it isn't you on the phone. You need to go to the county courthouse with proof other than a drivers license and prove you are not that person. Maybe a birth certificiate or something like that. Good luck.

DON'T THROW THEM OUT. IF YOU GET A SUMMONS YOU DO NEED TO GO. THE COURT WILL GET YOU IF YOU DON'T GO.

Sounds like a scam to me.

Just take the papers to the courthouse and explain what happened. The person will likely get fired if they were ever an actual employee.

They also need to get the papers to the right person so they can deal with their legal problems. If the suit doesn't have your name on it, it isn't connected to you, regardless of who they gave some papers to.

If it is not you, call the county courthouse and tell them what happened. The people serving are supposed to make sure they know who they are serving. It will be the real person, vs. the server's word that she was served or not, and unfortunately, the real person would probably lose.

Take the papers and go to the courthouse, explain the situation and bring proof of identity. You will be cleared and then it's no longer your problem.

this is easy. If it's not you, it not you! The person who served the paper is a civilian obviously. If they continue to hound you, call the Police department and file a complaint.

Go to the court house and take your id with you. You have proof that you are not the person being served.....Go show it....
