YES,I've had both done. It isn't always 10% of your paycheck either. In my state (Ohio) they can thake 25% of you check, and whatever they want from your account. The courts send a letter on behalf of the creditor telling the bank how much you owe. If you have more than that amount in your account they take whatever you owe, if you have less then they take it all. The bank has 5 after receiving the letter to do this. sometimes if you're a good customer the bank will call and tell you so you can take your money out, but they're really not allowed to. You find out when you start getting bounced check notices in the mail.

There are agencies that can and will. If you don't want this to happen then simply open up another bank and account and start using it and close the other one. Also request a new ATM card. As for your pay check they would have to go to court and not too many companies want to spend that kind of money.

they can garnish your paycheck. but it cant be anymore then 10% of your weekly gross income{before taxes}
