No. Don't kill him. In Ephesians 4:6 it says: Do not sin in your anger. Murder is a sin. Exodus 20:13- You shall not murder. Tell your neighbor that Exodus 20:8 says 'Remember the Sabbath day by keeping it holy'.

Exodus 35:2 refers to a court of law. Before the sentence could be carried out, the person would have had to be tried and convicted. Kind of like if you had a neighbor who murdered someone. You would not have the right to walk over an execute them. They would have to be arrested, tried, convicted and sentenced first by the state which would then carry out the sentence. So, no, you would not have the right to smite you neighbor. You could, however, testify against him if he was arrested.
