The legend came from the golden eagle because when the eagle has well oiled feathers, those on the nape and wing butts glisten brightly in the sun and when people first saw this bird in flight they saw the sun shining off the bird and thought it was carrying fire of it's back. Of course the eagle would have been very high up so they wouldn't be able to see it clearly just the glinting of the feathers. over the century's the story was elaborated and people would say it was made of fire and it was born from the fire and so on. But really it's just the humble Golden Eagle.

Here is a link to Wkipedia's info on The Phoenix. The legend varies from culture to culture.

I hope this helps.

p.s. The legend of the Phoenix has nothing to do with Harry Potter, but the author of Harry Potter used the legend as a literary aid in telling her story. The Phoenix is commonly seen as a symbol of goodness and justice. It is said to possess a certain level of self-awareness as to not allow itself to be someones 'pet' Miss. Rollings did a good job on pointing out that the Phoenix is for all intents and purposes a creature/being (which every you prefer) that sides one-hundred percent of the time with side of justice (which is not necessarily the same as siding with good).
