My ex-husband is an excellent father, he pays me support privately, no need for the district attorney. But when I was on welfare, and the divorce was fresh, we did go thru them, and they slapped him with arrears which he hasn't paid much of. Is this going to affect him being able to renew his green card? He has been trying to renew with no result, and my fear is that it is because of his back support. Anyone know about that? I'm in California by the way, in case that matters

Sorry, it will affect him. Once they run his name, it's gonna show up that he's late on payments. He'll end up being arrested if they let him stay, deported and not allowed to return legally if they choose.

The way the courts look at it is this: Why let a guy stay here when all he is going to be is a deadbeat dad?

IF you trust him and he trusts you, find a way for him to pay you the money, let the courts see the payments to clear the record and just give him the money back on the side a week or so after you know the paperwork is cleared up. No one need to know.

non-payment of child support in California is an offense! (probably elsewhere too, but I'm from CA so that's the only state I know for sure). They can prevent him from renewing his license, issue warrants for his arrest, withhold tax returns, etc. They can and will prevent his green card renewal until he pays in full. It's great he's paying you privately, but he has got to show the state absolute proof of these payments to you and bring his account to date.

from personal experience (friend) Green card holder bad stormy divorce paid cash to his EX for support of his 2 children she was collecting welfare and housing he was close to $18.000.00 in retro payments applied for Green card card renewal and no problem ICE told him it was a state civil matter .... go figure

immigration is a federal matter, he should seek out a immigration attorney. before hes ask to leave the country or gets deported, no green card, howdy osh.

It should. too many single mothers are struggling in the States, because too many fathers would rather be sperm donors.
