In NY you can not carry a baton at all , unless you trained, certified and are in security or police. the Halloween stores sell plastic ones

As long as it came with the costume yes, it is fine. Most batons or nightsticks that come with a costume are made of plastic or lightweight wood, not the same hardwood of the actual police batons. If it is added as an afterthought, it is illegal and the person can be charged with carrying an illegal weapon.

I don't know about N.Y. specifically but in many states a baton is classified as a billy club and is illegal to possess or carry. It's in the same category as sap gloves and brass knuckles. The only use is a weapon and you can't carry it, even at Halloween. The answers that just say it's "legal" are off-base. Check N.Y. law specifically and look for the crime of "possessing illegal weapons" or some verbiage like that. (Of course, if it is a plastic "fake" then it's not a weapon at all and it's legal.)

It's not legal in ANY state to carry a baton or night stick without being trained and certified with it. A police baton (PR24, etc.) is a deadly weapon and will kill if misused.

Provided you do not brandish it as a weapon, and it is not worn in a way that is threatening, you can crry it all the time. It is perfectly legal to carry it all the time.
