My family got a lawyer but didnt sign a contract but was paying him just incase we wanted to go through with him, but in the end we decided he wasnt doing a great job he was 3 months behind and just isnt satisfied with his work...we are in the process of looking for another lawyer. When i asked the lawyer to return the money he said he would until we have a contract with anothe lawyer. Can he do that even though WE dont got a contract together? We live in texas if that helps.

A lawerys retaining fee/fees may or maynot need be returned to you ,it all depends on what the agreement law of verble and writen contrats says. In a writen contract the lawery must conplete certain things in a timely manner of forfit the contract because of brechment or breching of said contract. The same would also be ture with a verble contract it would depend on what the state of Texas says about both writen and verble contracts.
