heres the scoop...the parents of a teen are suing the police department because their son was shot. the teen was climbing a fence and the officer shouted cease and desist. the teen turned to the right...the officer thought his life was in danger so he shot the teen ONE time. The teen was actually reaching for a cell phone located on his right hip...but the officer was unaware of this. it is important to the note that the victim continued to make movements after the officer said cease and desist.

See if you can't talk the victims of the robbery into suing the parents of the criminal teen for not raising their child right.

Its a unfortunate thing but the teen really shouldn't have been reaching for a cell phone while climbing the fence because the cops really are put in a bind when that kind of stuff happen they look at it like my life or his and you best believe the cops don't want to get killed either.

Ok, based on what is in your question:

The suspect was known by the Officer to be suspected of robbery, a forcible felony.

He was trying to escape.

When ordered to stop, he instead turned and reached for something on his belt, in a manner that greatly resembled reaching for a holstered firearm.

The Officer reached a completely reasonable (if sadly mistaken) conclusion that his life was in danger, and fired.

Unless you can show that the Officer was not acting in good faith (just trying to do his job), then the Officer was justified, and has Qualified immunity for his actions.

Now, this is based only on the information in your question, not the actual totality of circumstances for the incident.

A panicky teen, and an Officer who didn't want to get shot combine to create a sad ending. Of course, not committing the robbery, not running, and not moving when ordered to stop; any of these actions could have prevented it.....

Sounds like a justified shooting.

The family may sue if they choose. In a fair world the family wouldn't be getting anything for their moron of a son. In the real world they'd probably get some $ just to be done with the whole thing.

Lesson-Don't run from the police and reach into your clothing.

The cops don't need anyone to defend them on yahoo. Sheesh, if that's really what occured then procedure was followed. Sucks the kid got shot, but he should have stopped. The cops will be fine, they were doing the proper job in the situation.

the kid knew it was a cell phone. but the cop didnt know, so he had the right to protect his life.
the best way is even if ur DUI or have a turnk full of weed. juts give up

Theme was they were in fear for the life of others (even if no one else was around).
