A 17 year old boy has sex with a 15 year old girl. it's consensual! They end up having a baby, but now the father of the girl is threatening that he has up to 5 years to have the boy thrown in jail. Is this correct? They were both under age when it occured.

He should have waited until she was 16. It is a felony and he could get up to life. (18-1508. LEWD CONDUCT WITH MINOR CHILD UNDER SIXTEEN.)

The age of consent is 16 so it doesn't matter if she says it was consensual. She doesn't have that say for another year. The statute of Limitations is 5 years after the child reaches 18. So the District Attorney has until the girl reaches 23. Not only that, but the boy, if convicted, would have to register as a sex offender. Even though the age of consent for a male is 18, he is still older than the girl. It would be interesting to see if the girl was 17 and the boy 15, if they would go after the girl or even bother, I don't know. I'm just answering this, I am not sharing an opinion here.The web sites I got this from are below.

While the father of the girl can threaten a case of statuatory rape, he can only take the case to the prosecutor, the prosecutor makes the final decision about whether or not to press charges....

If the girl is not willing to testify in court most cases such as this are never persued... The fact that the couple have a child and are in a relationship and the sex occured while both were underage and the age gape is less than 5 years... the likelyhood of this ever reaching a court and the boy being brought up on statatory rape charges is slim.. .

The father can however make a huge stink and cause problems that could last for years for both his daughter and the boy involved....

Sounds to me like everyone involved needs to fess up to his.her part in it all and sitdown and have a long talk... there is a baby involved who doesn't deserve any of this and until all partys involved can stop being selfish, defensive and unbending... that baby is caught in the middle of the situation....

In Idaho, regardless if the girl said that it was okay. You can still go to jail. It would be the parents that can push it. She is to young and now the parents have the responsibility. But that is Idaho for you. (Or any state)

A 17 yr old can be tried as an adult. It doesn't matter if it was consensual sex or not it is still statutory rape.

Anyone under 16 cannot have sex, it is against the law..So dad is correct!
