Today I was sitting in my car in a parking lot waiting to pick up my kids. I pulled up behind a row of Handicap Parking Spots and waited. There was a woman in one of the Handicap Spots waiting for her handicap child. She obviously was upset that myself and others were parked behind the handicap spots so she jumped out of her car and started writting down everyones license plate. No one was in a spot and everyone was in a position to move if she needed to leave. I think that if she contacts the police with her info they will probably say that all they can do is send someone out to watch it tomorrow or that she does not have an enforceable complaint. Does anyone know the law on this one?

I was not parked in the spot. I was waiting in my car behind the spot. I do not park in handicap spots ever.

I just contacted my local police department and told them my story. For future reference for you all they said you can not be blocking access to a handicap spot in any way. If a police officer would have seen us it would be up to them to just ask us to move or write a ticket. Whether you are in your car or not. They said that the woman who wrote down the license numbers of everyone will not have a leg to stand on because they can not ticket off of hear say. I am glad I know that what I was doing is technically wrong and will be sure not to do that again! Tigger you are so on with your answer. I wish people were more courteous. Thanks Everyone.

Just don't park in thier spot and don't block it they take it very personal,,but if no cop was there ,,,don't sweat it,,,some people just upset with their place in life and enjoy just screwing with other's for the the heck of it,,,

First it is illegal, not sorta illegal, you are blocking someone from getting out and parked in a area for car movement, not in a parking place.
And obviously you are not handicaped and most who answered may not be. I am, and people taking, blocking and restricting handicap spaces is a big deal, and it is a area where alot of anger comes out. When you have grand kids using thier grandparents stickers or peopler just parking in those spots, Those of us who actually need these spaces often can't use them.
I understand this persons anger. If she would have asked you to move, you would have to.

I wish the woman would have talked to you instead of just writing down your license number or asked you to move. Passive aggressive people drive me crazy!!
Have you noticed there seems to be way more handicapped parking places then are needed in most places?
If you just parked behind a row of handicapped places i would think you are fine, but parking in a handicapped spot is illegal.

Yes, it is...because it blocks the access for the handicapped people.
It's just like parking in front of a driveway...illegal.
The handicap spots need to be readily available to the people that need them.

"If you don't understand how handicaped need to park here, go and break your ******** leg" Sorry about the language but i just quouted.

It is very illegal to block anybody in any parking space, and also a very selfish thing to do...
There used to be such a thing as common courtesy in America and it's so sad that with selfishness and greed it has all but disappeared. What you should have done, is immediately, when you saw her get in her car, you should have moved your abled body out of her way.

There's no such thing as a 'citizen's arrest' in this case! What a screwball!
In NYC, people double-park all day long and don't get ticketed. It's a matter of how much of another screwball police officer they can pair up with this lady.
As for me, I'd keep idling where you have been!

If you're sitting in your car and the motor is running, then you aren't parked. And you can't get a parking ticket. Period.
