EIC has nothing to do with someone being an ex-offender. The only exception that would be if your offense was tax fraud involving EIC. In that case you would be ineligible for ten years from the tax year of the fraud.

If you meet the criteria of age, income, and dependent child if applicable, then yes, being an ex offender doesn't matter for getting the EIC.
