I think that a pedestrian always has the right of way, even if they are in the wrong. If you accidentally kill someone while driving, even if you were in the right of way, it would not make you feel better.

Little known fact: A pedestrian has the right of way when aproaching a side road, while walking on the pavement of a main road as it is considered to be a continuation of the pavement. Any vehicles approaching the main road must therefore give way to the pedestrian.

Anytime they are off of the curb in a designated crossing, provided the light/signal ( if any) is in their favor.
If there is no signal, but the walkway has the familiar zebra stripes, the walker always wins.
