Consumer reports likes Honda and Toyota. If you want good gas mileage, look at the Lexus RX400h (hybrid) - very reliable, good gas mileage, great resale, and terrific safety record. The Highlander Hybrid is essentially the same car for less money. The Acura MDX/Honda Pilot are also excellent choices for the same reason, but don't get the gas mileage of the hybrids.
If you want something less expensive, look at the Honda CRV - a favourite of Consumer Reports, Gets in the upper 20s for gas mileage, great space, very safe.
I've had countless Jeeps. The reliability is down, gas mileage is still bad. We swapped to Honda. I'd be leery of Volvo due to reliability issues. Steer clear of Mercedes altogether. The M-class is a real lemon.

If you're buying used, then the best bet is the Infiniti Qx4.
It isn't too high off the ground, so is easy on your back to
get your toddler in the car. It also has a very high rated
Nissan V6 engine. The Jeep doesn't have a very high
quality rating and the Mercedes and BMW will cost you a bomb
to fix and maintain.
The second bet would be Acura MDX -- but you'll have to
buy used to keep in under $40k. The engine in these SUVs
is super, and again they aren't too high off the ground, nor
too low so will be easy on your back.

The X5 and the Jeep look reallly great but they do not have good reliability ratings. The most reliable SUV's are Lexus and Toyota (almost every model). My choice would be the RX400 by Lexus - just get the 2 wheel drive model, that's all you need. Check out www.consumerreports.org for the latest crash tests and reliability ratings. Also, the Honda Odyssey Van is highly rated.

I have a Chevy Equinox and I love it! My husband has a Durango, but I actually have more room in the backseat of the Equinox for a car seat. I can even fit my large stroller in the backseat on the floor of the Equinox when I need to put lots of stuff in the back. The Equinox also has better pickup and gas mileage than the Durango. I don't know about the vehicles you mentioned, I just wanted to give you another option. Sorry if I made your decision even harder.

I love the new Hyundai Santa Fe 7 passanger and the Saturn VUE. The hyundai becasue, well honestly because I work for Hyundai. And the 10 yr warranty is a great option. The Saturn VUE because the MPG is very good for an SUV.

Check out consumer reports.
I bought a Toyota Sequoia because it is safe, it has skid control, it tows and it is very reliable and long-lasting.
Toyotas and Hondas are usually considered the best. Toyota has the largest line of SUVs. They have all different sizes. You might want to look at the Highlander or RAV4.

It's not one of your choices, but I love my Honda Odyssey. It holds eight people, so I can fit my children, friends/family, and groceries comfortably. The safety ratings are through the roof, and the gas mileage is good.
Might be worth considering if you don't mind a van.

Holy freaking hell craps.
Whats a good choice for under 40k?
Lets trade shoes and you can make a real choice. Like what vehicle well under 10k you can somehow afford, that wont die, and you can still fit a carseat and groceries in, and yet isnt 10 years old.
Jeez. 40 thousand dollars. Thats more than half my mortgage.
