A jail is for holding accused person who are awaiting trial or for convicted law-breakers who are be in offenses. Prison are for removing from society those who have committed serious crimes.

The simple answer is length of your stay. Jail is some place you stay while waiting for an appearance before a judge. Sometimes shorter terms (usually less than a year) are done at a jail. A prison is much more secure and people are there for at least a year. Jails are run by a county or city and prisons are usually run by a state or a private company contracted through the state.

Jail is for defendants awaiting trial or arraignment of any charges-misdemeanors or felonies and have not been convicted as well as people convicted and sentenced to less than 1 year incarceration. Prison is for those convicted of a crime and sentenced to a 1 year or greater term. Jail is basically a place to house people whereas a prison is a correctional facility.
