and when I went to tell them it was my own private copy that she returned they said they never got it. I bet they have it and one of those librarians took it home. Should I sue?

How are you going to prove, that you'r mom took the book??
The book they have on hand, does it has: "Property ofxxxxx."??
If not, that book is you'rs.

Oh boy, I don't think you would be able to prove it. Did you talk to just one person at the library? I would call again and question: what do they do w/ items returned to the library such as this? Are they kept for a certain amount of time? ETC My line of thinking is this--did you get a lazy librarian who didn't want to go look, research what happened to it or wasn't aware of what is done with such items. I live in an area with a big library and very many staff--I would venture to guess that not all of them know all the guidelines on something like this.
If you don't get it back, I would chalk it up to a donation and tell the library you are claiming it as a deduction on your taxes!!

Can you prove beyong a doubt any of the following..
1. That your mother took that particular book to the library
2. If the answer to 1. is Yes. Can you prove that the book your mother took to the library belongs to you? (identifiable markings, a receipt, etc)
3. If the answer to 2. is Yes. Then you need to be able to prove that the book is still at the library.

Most libraries when they get copies of books they do not own are donated to charities. Libraries do not keep them

As a lawyer, I think you would have a hard time proving your case and would lose.

have a forensics man look for some of the fibers, than get a bigshot laywer and sue them for a mio. bucks, cuz you needed every single fiber.
