Yes, you are allowed something like 10% floor space extension without permission, however its best to apply for planning permission anyway, as tearing it all down wouldnt be good.

Get in touch with a conservatory company, get plans drawn up that leave a gap between the conservatory and the boundary and go ahead. Talk to your neighbour, show them your plans, explain you're going ahead anyway and involve them in the process. If you don't want to look into your neighbour's garden use mirrored glass on that side of the conservatory. If they're worried about the lights shining into their garden, put shading or curtains on that side too. Let the conservatory company deal with any planning issues.

It depends on the size of the conservatory and how likely it is to impact on the neighbours view.
Your local planning department or the company you choose to fit your conservatory will know.
We have just replaced our conservatory which was quiet small, and replaced it with one which is almost twice the size without planning permision, if it had been twice the size it would have needed planning permision.
The company that took our old one down and then built walls, laid the flooring and then finally installed the conservatory adviced us on planning permision, we decided to go for the slightly smaller version to avoid all complications.

I seriously don't think you would need your neighbor's PERMISSION, after all its your property. But in some instantances, its not a good idea to have your neighbors annoyed with you. Different states have different laws.
There may be building codes, (you will most definately need a permit) height limits, city ordinances etc. Do you live in a condo? Townhouse? Is there a Homeowners association you have to answer to?
Perhaps a good place to start is to check with your city hall?

You can legally extend your property up to 20% of its floor area WITHOUT PLANNING PERMISSION. Any bigger than that, you will need to apply for planning permission.

Some communities have maximum footprint allowances for structures per property. Best to check with your local jurisdiction. Also may have minimum space to property line rules . . . again check with local authority.
