According to an ice cream man on Radio Cumbria the other week, it's the flake part that makes it a '99'. And it got the name because the cone used to be/is 99 mms long from tip to top.

An ice cream is only a '99' if it has a cadbury flake included. In 1930 Cadbury started producing a smaller version of the standard Flake bar especially for ice cream cones. These were marketed under the name 99 Flake and sold loose in boxes rather than individually wrapped like the traditional Flake. So its not the ice cream that is a '99' but actually the flake

HA! I answered this same question yesterday and I researched it so its right. ok its something like this:
ice cream makers were usually Italian. the Italian king always had 99 guards in his army and 99 was considered an elite number so these italian ice cream makers decided to name this ice cream a '99'...
