Actually both are to blame... it's one of those reasons why no-fault insurance is a good thing to have. It's tough to prove who hit who first. The only exception is if you try to move to avoid the collision and they still hit you, then it's their fault.

If it can be proven that one car got out of the space and was there in the aisle first, then the other car that was backing is at fault. If it is honestly and truly both of you backing at the same time it's 50/50. Both owed the same duty to each other and both breached the same duty. Equally at fault. Without specifics that's all I can tell you.

Funny you asked that actually lol. The other day I was in a corner parking space and I was backing out. I was going slow looking and suddenly a car comes whipping around the corner at my car and came verrry close to hitting my car. They stopped obviously and i slammed on my brakes put the car in drive and my car went backwards and not forwards. My friend who knows alot about cars says I switched gears too fast. I wonder who would hav been at fault it we hit each other.

Depends where you are. Michigan has no-fault accidents because there's no use debating it. If one or both people broke any laws they'd get a ticket. Otherwise you'd claim it on your own insurance and possibly take it to small claims court to settle it there.

That sounds like a 50/50 deal to me. Neither driver was apparently paying attention.

However, if one driver stopped and the other driver continued to back into him - well, that's a horse of a different color.
