You need to do a K-1 Fiance visa. This would be the similest method but it has to be done properly or they will be very harsh punishments for expiring this visa. You guys by this time should have letters/pictures of proof that you have been meeting each other for some time. The mexician citizen needs to present this at the visa office in their country to obtain the K-1 visa. He/she will get this visa rather quickly. When he/she comes into the US you will have to marry this person witin a 90-day period. Then this person can adjust to LPR (Liscensed perminate resident).

It will be difficult b/c he is Mexican. You should consult a lawyer. In the meantime, here are my suggestions:
If he is currently in Mexico, you should apply for a K-1 fiance visa. Once the K-1 is approved, he can move to the U.S. legally. You must get married within 90 days and then immediately after marriage file for an adjustment of status for a green card. The other option is for him to come to the U.S., if he can get any other valid visa, including a B visa. Once he enters the country, get married ASAP and file for an adjustment of status.

The laws are very favorable for spouses of US citizens. A US wedding will be easier to pass through the system and then you just have to apply for the visa as a spouse. There are more little steps in there, but getting a legal marriage and marriage certificate are the first steps. Your spouse may need a SS# first. Best to stop by the courthouse. They should be able to give you all the forms.

It's the same as getting married to a Canadian or whatever. Same rules, but the only thing is that its alot harder for a Mexican to get citizenship or even a visa and they have to pay lot's of money (which . . . no offense, but they dont usually have). Contact an immigration lawyer.

I will tell you how my husband and I did it....This was three years ago, please check with the INS before you do anything, for laws may have changed....
My hubby came here on a tourist visa and we got married here in the States....We then filed all the proper documents, it takes several steps.....If you go to INS webpage it will explain everything, what you will need and what to present....You will need to show employment for at least three years (tax returns)....During all this process, make sure your new hubby does NOT travel back to Mexico, for any reason, or he will NOT be allowed to re enter for 5 years! They don't tell you this at INS...Best of luck!

It will be easier if you get married in Mexico, then petition for him. You should have a court date in 6 weeks or so, then he will come here LEGALLY.
