I was charged with a felony for possession of a controlled substance back in August. It was cough syrup with Codene. I have not been convicted. I have not even been in for the role call appearance. I live in Utah and have a job interview this weekend in Seattle. I was told by my attorney earlier in the week that I should be fine leaving the state as long as i'm here for my court dates. I'm not under any kind of supervision. My brother who has practiced law in another state told me that I may get arrested when traveling when the airport verifies my identity. My question is will a pending felony 3 case show up on my record when security checks me? Also, I was planning to go to Vancouver for the day with my fiance after my interview. Will this cause problems trying to do that?

I contacted my attorneys office this morning after my brother scared me. My attorney is out of town until next Tuesday. That's why i'm turning here.

Typically, when you've been charged at this point, even before being arraigned in court, you're fine to travel as you like. I'm not as clear about traveling between two different countries though. I imagine you're still clear to do that as well. It's not as though you're facing murder charges! Just make sure you appear in court for your scheduled appearance. If not, you could be considered a fugitive of the law, and that makes travel very difficult! Good luck!

Ask the ones that are gonna arrest you. Every state does treat that in there own fashion , but felony law is on a different level. You may be fine, you could get arrested and be in a funny jail.
Call Canada Embassy and ask them, cause our Federal laws and each States Laws are or can be very different than their interpretation.
Pending Felons are normally advised of the Rights that now apply, like travel and such. In most states a Charged Felon awaiting a Court Appearance aint sposed to leave the Town Limits,City Limits or County. So far your ok, asking advise of an attorney is all ways better than just getting arrested for stoopid stuff that could have been avoided.
There are entire libraries of books written on this, and even they are subject to the Current Understanding as to if they are applicable. The Interpertation thing comes back in there, and that is what the Courts are for. If your attorney that is working on or appointed to this case says okies, well okies. Have fun, its the least that one can do.

Unless you will have court docket premission you are going to be charged with "Unlawfull flight to hinder procicution" and might be desired as a fugitave through the FBI tell your attorney that you simply wish to head. YOU WILL BE CHARGED WITH A FELONY IF YOU DO NOT HAVE COURT PREMISSION. I don't believe that the court docket will provide premission in case you have been discovered responsible of prison or violent expenditures. I doubt (besides underneath extreame occasions) that the court docket will provide go away except you're aquited of all expenditures. You're paying lawyer to advise you. Why would you second-guess that advice by asking a lot of ill-informed strangers on the internet what you should do??? Listen to your lawyer.

Listen to your lawyer. Different states have different laws. Your brother may be right, but it may be rules for another state.
