I'm not sure if there are laws that say when it has to go on, look in your lease to see what it says there. I know here in Pennsylvania, most landlords don't want to turn the heat on until late October if you're lucky, most will do it in November.

Maybe you can have a talk with him and explain that you have a small child and your house is too cold without the heat on. If he still won't turn it on, I don't think you have many options. Consider purchasing a small electric heater to tide you over.

Heat should ALWAYS be avaliable to you reguardless if you have it on or not. Reguardless if you pay untilities or not. Tell that landlord to stop being a slumlord and turn on your heat or you will have to resort to take action and call the authorities in.

With a small child in the house, that is what you tell your land lord, Most will do it because of that. They won"t know if you do not tell them!!
