well, i had a crash last night, my car's a write off, the other car is drivable and only has a slight dent in the body work. i'm scrapping my car and buying a new 1. do i still have 2 claim on my insurance in regards 2 the other guy? he woz speeding (not that he'd admit it) and went in2 my drivers side as i was pulling out of a side road i didnt see him until it happened even though i was lookin his way as i turned (hense the speed he was travelling).it was kinds dark, 6:15 last evening, he had side lights on. thanx

You need to report it with your insurance company and the police. Let your insurance company talk to the other company and let them sort things out. And as much as I loathe attorneys you might want to do a free consult with a local at tourney to make sure the answers you've received from this site make any sense!

As you pulled out into his path from a side road he may want to claim off your insurance for the damage to his car. So you should inform the insurance company that you have had a crash. Exactly whos fault it was is difficult since you would have to prove he was speeding, which is notoriously difficult. If your insurance company decided to contest his claim (assuming he does try to claim) then it could end up being decided in court. Also if you are certain it was his fault then you could try and claim of his insurance company. However as I said earlier, as you actuallu pulled out into his path, it would be hard to prove it was his fault.
Either way you should let your insurance company know since if you don't an they found out about it they could cancel your policy.

You could offer to pay for the damage to the other car rather than have him claim on your insurance, but you do still need to inform your insurance company that you have had a crash.

The first thing to do after a collision accident with another vehicle is to call the police. The officer gets a statement from both drivers to file a police report. The police report is used as evidence by insurance companies. It is a recorded facts of the loss fresh at the time of the accident. You need to call your insurance company. They will ask you more specific questions to determine who's liable for the accident(meaning who's at fault). I work for the insurance company so there's no easy answer when it comes to certain accidents.

You are at fault for this accident, so, yes, you do need to report it. The other driver was already established on the roadway and you bear the greater duty to keep a safer lookout when enteriing the roadway from a side road. Doesn't matter how fast he was going unless you have an independent witness to support the speeding allegation (someone who wasn't in your car would be independent). The points of impact are also going to support the liability---his damage is going to be on the front and yours on the side...this one is unfortunately not contestable. Call your insurance and let them pay for it. A dent on the body of his vehicle is going to exceed $1,000 in all likelihood and unless you can afford to pay him out of pocket your property damage coverage will take care of it. There is no deductible for pd, so it won't cost you anything but a premium increase.

Police should have been called because it was an RTA (Road Traffic Accident) and it would be an offence for persons to leave before the Police had made initial investigations.

i hope you exchanged insurance details, or at least got the car type and reg... other information would also be useful.... eg about the driver of the vehicle, colour, approx age, etc....

Once the Police bit is over..... Contact your insurance and really play it up.... You'll probably need the incident number from the Police at this stage though!

Yes you have to tell them. Sounds like you're probably at fault. I am not sure where this happened, but if he was on the main road (speeding or not) and you pulled from a side road, you failed to yield right of way. Call them now and see if they want to see your car before you scrap it. In the event that they can pay him less because he contributed due to his speed they'll need proof that he was speeding. Maybe if you live in a comparative negligence state or a contrib state they can deny him or reduce the amount they have to pay. Don't be surprised, though, if they pay it all because he did have the right of way.

Were the police called. Was an accident report filled out?
Have you called your insurance carrier? Has an adjuster been in contact with you yet? Did you get third parties insurance info or license plate number? Did you seek medical attention?
If not there probly is nothing you can do but put it through your insurance and pay a higher premium.
Did he call his carrier? etc etc etc. If not scrap the car.

Always call the police when you are involved in an accident. If it was truly the other driver's fault, then the police report will state that. That means that his insurance is responsible for payment for damages to your car. Since it doesn't appear that you have done that, then it is your word against his about how the accident happened. Each of you should submit a claim to your own insurance for your own cars. He cannot claim against yours and you cannot claim against his. Each company will reimburse for the vehicle insured with them.

I believe the cause of the crash will be deemed as your fault because your were entering a main road from a side road. Unless you can prove his speed was excessive - which you can't, you will have to claim on your insurance and he will probably claim on yours for the damage to his car. If you didn't exchange names addresses, car and insurance details neither of you will be able to claim off the other as you will have lost contact!

you should report it to your insurance. usually in these sort of insidents it is seen to be the fault of the person pulling out of the side road, however if the other drive was doing something wrong then you need to have someone fighting your corner too, even if you dont claim on your insurance for your car, the other person may be trying to claim against you. also if the other drive is found to be at fault then their insurance may well pay for your car. so definitly worth a phone call to report it.
