The person that hits you from behind is wrong as they didn't leave a safe distance between themselves and the car in front (you). If, as previously mentioned, you cut them up and hit the brakes it's their place to prove it - and it's very hard to prove.

Tell your insurance company what happened and don't enter into ANY conversation with the other party or their Insurance company - that is your insurance company's job!

It depends on which side of the road you're driving at the time
of the accident. If you're on the correct side of the road and
driving your car normally and suddenly, someone hits you from behind, for no rhyme of reason, then that person is at fault.
He's liable for a penalty.
You can make a police report and his insurance company is
liable to pay for the damage or repairs to your car.
Make sure to take a photo, write down the driver's personal
particulars and his car's registration number, the date, time and
place of the accident. Also write down briefly how the accident
occured.

Most of the time they are at fault. If you are found to have default with your vehicle, or that you didn't give ample amount of warning, you also could be found at fault. This would be determined by the officer who investigates the accident.
I was involved in an miner accident, where I pulled up to a stop sign behind a car. That car had taken off, I went to take off in my semi, and hit the rear quarter panel and left side of the rear end of a car that had come up the shoulder. I did not see this car. When the officer investigated the accident, he didn't write either of us up. So it will be up to the officer, as to who is at fault.

The guy in the rear is wrong. They ALWAYS come up with stupid statements like "You stopped too suddenly" or "why did you stop for nothing" etc etc.

The FACT is, if they were following at a safe distance, as the vehicle code requires, it wouldn't matter WHY or how quickly you stopped.

If you cut in front of a person and slammed on the brakes, well, maybe you lose.

it is not automatic that the driver behind you is at fault. What you done that contributed to the accident will be looked at also, as an example you cannot suddenly slam on your brakes on a crowded freeway because the phone rang and expect everyone to avoid you. It is called contributary negligence and you may be assigned a percentage of the fault.

They are because they are suppose to be in control of their vehicle at all times. They could counter saying the other slammed on the brakes intentionally or made an illegal lane change, but for now at least in Michigan, they would get a ticket for rear-ending you.

Laws very from state to state...again it would depend on the circumstances...if the lead driver was legally stopped..ie at a stop sign or light, then the driver of the rear vehicle is at fault...but if the lead driver made a sweeping pass , pulling in front of the other driver then stopping abruptly then its the lead drivers fault...hope their was plenty of good witnesses...
