His original charges of possesion, manufactor and delivery of a controlled substance originates from polk county, Dalles OR. The PV is for changing his address without permission. He has no prior offenses of this sort.

He may be arrested and have to post bond or stay in jail until his hearing on the parole violation. In his own best interest, he should turn himself in. His is a rather minor probation violation and should not result in being sent to prison, or jail if on a misdeameanor charge. If he has an attorney, I suggest contacting the attorney and have the attorney go with him to surrender. He may also want to contact his probation officer, maybe after talking to the attorney. The probation officer may be able to get the warrant released without your boyfriend havng to go to jail. The exception may be if your boyfriend has other pobation violations that have been addressed, but this is a continuation of his ignoring the conditions of probation. Also, you say he has no prior offenses of this sort, but if he's been convicted of other unrelated offenses, his probation officer may consider him likely to repeat offend because he violated probation and want to get him off the street. When a person is given probation for an offense as serious as making and delivering a controlled substance, especially if he also had in his possession a large enough amount of drugs to constitue a felony, probation officers take a dim view of failing to follow probation rules. In the end, though, its the judge who decides if your boyfriend goes to jail or prison so having an attorney is a good idea. Tell him not to delay.

Laws and rules concerning probation vary from state to state. In my state, if you receive a probated sentence and violate your probation, the Judge can revoke the probation and you then serve the sentence given at your trial. From a reading of Oregon law, the judge upon revoking probation then orders a prison sentence.

Understand this: A probation violation IS NOT a parole violation. Violating terms of probation can be, as you know, as simple as not reporting an address change. When you are granted probation you must follows the terms set forth by the court AS WELL as by the probation officer/department. A granting of probation is typically a set of rules you must follow in order to avoid a more punitive dispostion such as jail. If you violate, you can be taken back to court and face the origianl penalities of the crime you were convicted. Every law violation carried a maximum sentence. For example, in California if you are convicted of petty theft (misdemeanor) you face a maximum of 6 months in the county jail. Probation Violations fall under Penal Code 777 and carry no sentence guidelines. Therefore you can only be held to answer to the irginal punishment allowed for the convicted crime. Not reporting an address change is minor but can result in arrest. If however your boyfriend reports the change, has a reasonable explantion his probation may be reinstated without any further punishment.

He will be arrested and have to go before the judge for a determination of what will happen now. If they decide to revoke everything goes back to square 1. He will have to serve the entire sentence pronounced when he received his probation. If not, then things will go on as they are.

Why is he still your boyfriend? Are you of such low self esteen that you are hanging around a drug dealer? Run....far and away from this guy!!! Call him what he is...a DRUG DEALER. He'll NEVER amount to anything with that kind of conviction. He can't even get into the National Guard!! Oh, by the way, he'll be locked up for the PV. DOC had to issue the warrant and they won't do that with being ready to send him away!!!

The results, He can go to jail. But keep in mind that it sounds like he likes dealing drugs. This is the life you want? But again probation violation he can go to jail for this. That will depend on the courts and his attitude.

He better go straiten it out. It's too late to leave and wait for the statute of limitation to run out, once convicted, he has to get clear. Next time, get clear Before the trial,. and wait it out, and tell him to be a good boy.
