An annulment simply states the marriage never took place and there is usually no alimony involved, no kids to prove the marriage was ever consummated.

A divorce states that there was a marriage (because the kids are involved and shows the marriage was consummated) and the state recognizes the divorce as do many religions.

The best thing to do is check with your clergy as to your religious obligations in your particular parish. the state will determine your divorce obligations as to alimony, child care, tax deductions, etc.,.... as per your attorney.

An annulment usually can only be filed within 30 days after the marriage license was issued. There also has to be good reason - such as abandonment, the person was not legally divorced or a bigomist, you were coerced or frauded into the marriage, etc - for an annulment to take place. You are legally recognized as "single" not "divorced".

A divorce is a legal termination of marriage past the statutes of annulment. Generally there has to be a reason - Again such as abandonment, affairs, etc.

A court can deny either annulment or divorce.

An annulment is a much easier process, but is much more difficult to have granted than a divorce. Annulments make it as though the marriage never happened (you would call yourself single-never married, instead of single-divorced).

It used to be that annulments could only happen if the couple did not have sex (the marriage wasn't consummated). This is no longer so.

The requirements for annulment vary by state. In my state (Wisconsin), you can only have an annulment granted for two reasons, if the marriage was invalid from the beginning (eg. one spouse may have been too young to marry, incapable of consenting to marriage, or induced to marry by fraud or force), or because of fraud (eg. one spouse never disclosed to the other spouse information about such things as a previous marriage, a criminal record, an infectious disease, the inability to have children, or the physical inability to consummate the marriage).

On the other hand, divorces can be granted to anyone who asks for one in most states, but are much more costly and time consuming. Unlike with annulments, divorce involves alimony, division of assets, child custody, etc. , which usually means more time in court and more fighting between the spouses.

There shouldn't be any, but in the Catholic Church they can get an annulment (after they are divorced of course legally through the system) and it means "the marriage never happened" and the Catholic spouse can then remarry in the church...a divorced Catholic cannot remarry in the church without one.

Annulment usually you can get the first 6-9 months married,soposslly if uses never had intercorse because they consider that the marrige was not constaplated,A divorce is when you,ve been with your partner as atually been together as husband and wife!Hollywood

A divorce is a civil end to a marriage. This is finalized in a courthouse.
An annulment is a religious end to a marriage. This is finalized in a church.

you can only have an annulment if you have not had sex- divorce is a slow painful process while an annulment is quite easy
