Earlier this summer I recieved a letter from the DMV saying I needed to get a smog check or send in proof that I've had one within the past two years. I didnt have the reciept for the smog check, and forgot about it over summer.
Last week I went online and printed out my vehicle test statement, that proved I had one in march of last year, and sent it to the DMV, requesting they send me my car's registration for this year ASAP. I still havent recieved it (I'm assuming it's en route), and so when I parked downtown today, I got a ticket for not having my sticker on my car. Is it possible for me to fight (AND WIN) this? If so, how and where do I begin??

Sorry to hear about your situation, but unfortunately, ticket writing is one of the biggest scams that the government uses to take our money.

The state of course will argue that it is your responsibility to get the sticker, and they don't care if you sent anything in or not. All they want is the money.

One wonders how many real crimes could be prevented if the city assigned more cops to high crime areas vs. shaking us down to fill their coffers.

A lot of times if you can get the car registered within 10 working days of the ticket, they will dismiss the ticket with a small fee.

Does your vehicle have a current registration, or is it expired? If it's expired, and you got a ticket, there isn't much you can do. The fact "You forgot about it over the summer" won't hold much weight for the judge.

You say you sent in proof of inspection. Did you also send the fees for your new registration? If not, they aren't going to send you anything but a bill for registration. There may also be a penalty if it is expired. In the mean time, until you do get current, I'd suggest you park the car.

Possibly, depends on the state/county. It's not the same thing, but in Florida if you don't have your insurance card or registration card on you, and you get a ticket, and it's all current, you can go to the clerk's office & show the proof, and they reduce the fine to I think 9.00 as opposed to the full ticket price(forget what it is).

Try calling the clerk's office where the ticket was issued and ask them. If you end up having to go to court, bring in the receipt of having the test done with the date, bring in the current sticker, and save the envelope it came in that shows the postmark date of when it was sent to you to compare with the ticket date.

And, I'd venture to say driving school isn't an option, sounds like it's a non-moving violation in your state.

Where do you live? I am in the process of fighting a photo-inforced ticket. There is a very popular lawyer in San Diego that is nick-named mr. Ticket. He has an extremely good rep...google him on the web. He may be able to give you advice if nothing else. His fee for taking your case usually runs about 100.00. Which is great if he wins and not so great if he doesn't. But many times you can go to traffic school so it is not on your record even if he doesn't win the case......GL.

Yeah, get a sticker ASAP and show it to judge at the designated time of your court appointment.
